Provo Water Company Ltd. – Terms and Conditions of Water Service
I/We certify that all information provided to Provo Water Company Ltd. (“PWCo”) is true, accurate, and complete. I/We understand that any false, misleading, or incomplete information may result in refusal of service, additional charges, suspension or disconnection of water service.
I/We understand and agree that all services are provided subject to the rates, fees, policies, regulations, and operational requirements of PWCo, as may be amended, revised, or replaced from time to time.
I/We understand that connection or reconnection of service will not be completed until all applicable fees, deposits, and outstanding balances have been paid in full.
I/We acknowledge that upon installation of the water meter and payment of the required security deposit, the account shall become active and billable.
I/We acknowledge that the applicable minimum monthly charge shall apply in order to maintain an active account and continuity of service regardless of water consumption.
I/We acknowledge that all meters, meter boxes, seals, shut-off valves, and related infrastructure installed by PWCo remain the property of PWCo and may only be serviced, adjusted, removed, or relocated by authorized PWCo personnel.
I/We acknowledge that PWCo’s responsibility ends at the shut-off valve located near the water meter. I/We accept full responsibility for all plumbing, piping, fixtures, fittings, and water losses occurring downstream of the meter, including losses caused by leaks, damage, or third parties. I/We further acknowledge responsibility for regularly monitoring water usage and promptly repairing any leaks or plumbing defects on the property.
I/We acknowledge that PWCo will endeavour to maintain a normal operating pressure of not less than twenty (20) PSI at the service connection. I/We understand that additional pressure-boosting equipment may be required for multi-story buildings or properties requiring higher water pressure, and such equipment shall be installed and maintained at my/our expense.
I/We agree to provide PWCo with safe, unobstructed, and unrestricted access to water meters and related equipment at all reasonable times. I/We understand that PWCo reserves the right to suspend or disconnect service where access to the water meter has been restricted, denied, or deemed unsafe.
I/We understand that tampering with, damaging, bypassing, interfering with, or removing a water meter, or any PWCo infrastructure is strictly prohibited. Unauthorized connections, theft of water, or use of water service without authorization from PWCo are also prohibited and may result in immediate disconnection of service, assessment of estimated consumption losses, a tampering fee, and possible reporting to the Royal Turks and Caicos Islands Police Force (RTCIPF).
I/We acknowledge that PWCo may charge the account holder for any damage to water infrastructure, meters, meter chambers, valves, or related devices caused by negligence, misuse, unauthorized interference, or damage caused by the customer, occupants, contractors, or third parties associated with the property.
I/We understand that accounts are due within fourteen (14) days of the billing date and that overdue balances shall incur a late payment charge of two percent (2%) per month. Accounts remaining unpaid may be disconnected without further notice, and all outstanding balances, applicable penalties, and a Twenty-Five Dollar ($25.00) reconnection fee must be paid prior to restoration of service.
I/We understand that where a meter reading is unavailable, inaccessible, delayed, or inaccurate, PWCo reserves the right to estimate consumption based on prior historical usage patterns and/or comparable billing periods.
I/We acknowledge that a Ninety-Five Dollar ($95.00) fee shall apply to all cheques returned by the bank as Non-Sufficient Funds (NSF). Accounts affected by NSF payments may be subject to immediate disconnection and must be settled in full, including all applicable fees and penalties, before service is restored.
I/We hereby authorize PWCo to disconnect any additional accounts held in my/our name where any account becomes delinquent or payments remain outstanding. I/We further authorize PWCo to apply deposits, credits, or payments held on any account in my/our name toward outstanding balances owed on other accounts held by me/us.
Bills, notices, and other communications will be delivered electronically, including through the PWCo Web Portal, and shall be deemed properly delivered once issued by PWCo. I/We agree to promptly notify PWCo of any change in ownership, tenancy, email address, telephone number, or other contact information associated with the account.
I/We understand that requests to close an account must be submitted in writing at least forty-eight (48) hours prior to the requested disconnection date. Customers remain responsible for all charges until the account is formally closed by PWCo. Any outstanding balances shall be deducted from the security deposit held on the account, and security deposit refunds shall be processed approximately fourteen (14) days after account closure.
PWCo does not guarantee uninterrupted water service and shall not be liable for interruptions, pressure fluctuations, discolored water, temporary reductions in service, or delays resulting from maintenance, repairs, emergencies, power outages, acts of God, or circumstances beyond its reasonable control. PWCo shall not be liable for indirect, incidental, consequential, or special damages arising from water leaks, plumbing failures, service interruptions, pressure variations, customer equipment failures, or conditions occurring beyond PWCo’s point of responsibility.
PWCo reserves the right to suspend or disconnect service for non-payment, safety concerns, unauthorized use, theft of water, meter tampering, denied access, policy violations, breaches of these Terms and Conditions, or any activity that may compromise the integrity or safety of the water system.
These Terms and Conditions shall be governed by the laws of the Turks and Caicos Islands and all applicable utility regulations.
